Supreme Court slams Bihar government, asks ‘Are children not citizens’?

The Supreme Court of India Tuesday came down heavily on Bihar government and asked, “Are children not citizens?” The top court slammed the government for not filing a case on sodomy allegations at shelter homes in the state.

In Muzaffarpur shelter home case, Supreme Court slammed Bihar government over its failure to file correct FIR and has given 24 hours to add charges under section 377 (rape) IPC and POCSO Act in the FIR.

The apex Court said, “What are you (Bihar govt) doing? It’s shameful. If the child is sodomised you say it’s nothing? How can you do this? It’s inhuman. We were told that matter will be looked with great seriousness, this is seriousness? Every time I read this file it’s tragic.”


According to news agency ANI, Supreme Court added, “If we find that there were offences under section 377 IPC and POCSO Act and you did not register FIR, we will pass an order against the government.”


The apex court has asked counsel appearing for the CBI lawyer to take instruction if CBI can investigate the cases relating to sexual assault in nine out of 17 shelter homes in Bihar named in the TISS report.
